In the event you are ever put into the situation to have a law enforcement officer read you your rights, you should immediately inform him or her that you do not wish to speak to them, or make a statement without an attorney present.  By law, at that request, they are not allowed to question you any further. 10 things you need to know. 1.  You are innocent until proven guilty beyond a reasonable doubt. 2.  You do not need to prove you are innocent; rather it is the states obligation to prove any charges against you. 3.  Often we get a case or a charge dismissed because the police fail to follow the law. 4. Your entire future depends on the out come of this charge. You do not want to end up with a conviction on your record.   5.  Often lawyers use scare tactics, threats of prison time to get you to hire them. I use positive well though out strategies on how we can make this problem go away. 6. If you have any prior run in with the law I need to discuss this with you as the outcome of you case may be more critical than if you had no prior charges. 7. Often lawyers do not work hard for you. Not only will I work hard for you, I believe you will send me clients based on your great result. 8.  A run in, or arrest under the law is an unpleasant experience. Therefore, you need a positive experienced advocate to fight for you rights. 9.  There is a big difference between a plea, a trial, or a pre-trial program you need to know these differences. When you ask a lawyer to quote you a price ask him to tell you what he is going to do for you. 10.  I will often prepare and file a pretrial motion to get your case dismissed. You’ve heard “if the glove doesn’t fit you must acquit” I’ve got better ones then that. The most expensive lawyer is not the best lawyer. He is just the most expensive. You need a reasonable priced lawyer who cares about you not just about your money. Success is where preparation meets opportunity. As your lawyer I must do my best work for you because that is what you expect and deserve from me. I Demand to Have an Attorney present before I speak to you. I will not talk to you or anyone about anything. I will not answer any questions or reply to any charges without my attorney present. I Do Not Agree to perform any test, allow my property to be searched or participate in any lineup. I Will Not Sign anything unless my attorney agrees I should do so. I Will Not Waive any of my Constitutional Rights. Defendants Rights You have the right to a speedy trial You have the right to a jury trial (in most cases). You have the right of presumed innocence.
